Object and scope of application

These General Terms and Conditions regulate access to and use of the www.landexpert4x4.pt website and apply to all commercial transactions carried out through the Lima & Oliveira Lda online shop, hereinafter referred to as ‘Land Expert 4x4’.

By browsing the site or placing an order, the user declares to have read, understood and accepted these Terms and Conditions.

Land Expert 4x4 reserves the right to change these conditions at any time, and any changes will be published on the website.

Products and orders

The online shop offers car parts and accessories, particularly for Land Rover vehicles.

The product images are illustrative and may not correspond faithfully to the product delivered.

The customer should check the detailed descriptions before purchasing.

Once the order has been completed, the customer will receive a confirmation e-mail summarising the order.

Prices and payments

Prices are in euros (€) and include VAT at the legal rate in force.

Before finalising the purchase, the customer will be informed of the total price, including shipping costs.

The payment methods available will be indicated at checkout and may include: credit card, MB Way, Multibanco reference, bank transfer, among others.

Deliveries and shipments

Orders are dispatched to mainland Portugal, the islands and other foreign countries.

Delivery times are indicative and may vary depending on the carrier or destination.

Land Expert 4x4 is not responsible for delays beyond its control.

Right of Free Resolution

The customer has the right to withdraw from the contract within 14 days of receiving the product(s).

To exercise this right, please contact us by email, quoting the order number.

Products must be returned in perfect condition, with no signs of use.

Return costs are borne by the customer, unless an error is attributable to Land Expert 4x4.

Refunds will be made within 14 days of receipt of the returned items.

Guarantees and claims

All products are covered by a 3-year legal guarantee, under the terms of Decree-Law 84/2021.

In the event of a defect or non-conformity, the customer should contact Land Expert 4x4, describing the problem and, if possible, attaching images and videos.

The guarantee does not cover damage caused by improper use or incorrect assembly.

Responsibilities

Land Expert 4x4 accepts no liability for damage resulting from interference, viruses or other computer incidents.

We accept no responsibility for any violation of local laws in the country of destination of the orders - it is up to the customer to check the legality of the import.

Intellectual Property

All the contents of the website (texts, images, logos, design) are protected by copyright.

Total or partial reproduction of the contents is only permitted with written authorisation.

Trademarks and distinctive signs displayed on the site are protected under the legal terms of industrial property.

Obligations of Users

Users undertake to:

Not to disseminate content that is offensive, illegal or violates the rights of third parties;

Provide truthful and up-to-date data;

Not share their password with third parties;

Not create false accounts or use other people's identities.

Land Expert 4x4 reserves the right to suspend or delete accounts that violate these obligations.

Alternative Dispute Resolution

Under the terms of Law no. 144/2015, consumers can turn to an alternative dispute resolution (ADR) organisation.

Suggested ADR body: Centro de Arbitragem de Conflitos de Consumo do Vale do Ave (www.triave.pt) or another competent centre.

Applicable Law and Jurisdiction

These Terms and Conditions are governed by Portuguese law.

In the event of a dispute, the courts of the district where Land Expert 4x4 has its registered office shall have jurisdiction, without prejudice to any mandatory legislation applicable to the consumer.
